Terms of Service

These Terms of Service (“Terms”) govern your use of One Place Plants (“OPP”, “we”), a marketplace connecting buyers with local plant nurseries. By creating an account or using the site, you agree to these Terms. If you don't agree, please don't use OPP.

1. What OPP is

OPP is a marketplace, not a nursery. We provide the platform that lets nurseries list live inventory and lets buyers discover and purchase plants matched to their growing zone. Each nursery is an independent business responsible for the accuracy of its own listings, the quality and health of its plants, and fulfilling orders (pickup, delivery, or shipping, as offered). OPP is not a party to the sale between a buyer and a nursery beyond facilitating payment.

2. Accounts

• You must provide accurate information and keep your login credentials secure.
• You're responsible for all activity under your account.
• You must be able to form a binding contract to use OPP (generally, 18 or older, or the age of majority in your jurisdiction).

3. Buying on OPP

• Listed quantities reflect a nursery's self-reported inventory. We display a “freshness” indicator showing how recently stock was confirmed, but we don't guarantee availability at the moment you check out.
• Payment is processed by Stripe at checkout. Funds are held and released to the nursery per our payout schedule.
• Pickup, delivery, and shipping logistics, timing, and any related fees are set by the individual nursery.
• Refunds, exchanges, and plant-health guarantees are set by each nursery's own policy unless otherwise required by law. If a nursery doesn't resolve an issue, contact us and we'll help mediate.

4. Selling on OPP

• Vendors must keep listings, quantities, and photos accurate, and confirm inventory regularly to keep listings visible.
• Vendors are responsible for the health, safety, and legality (including any required plant-shipping permits) of everything they sell.
• Vendor payouts run through Stripe Connect. Vendors must complete Stripe's identity verification to receive payouts.
• OPP charges a platform fee of 5% of the order subtotal, capped at $25 per order, in addition to any subscription plan the vendor has chosen. Fee amounts are shown before a sale completes and may change with notice.
• Vendors may not use OPP to circumvent these Terms, list prohibited items, or misrepresent their business.

5. Prohibited conduct

You may not:

• List or sell anything illegal, invasive, or restricted in the buyer's or vendor's jurisdiction.
• Misrepresent inventory, pricing, or your identity.
• Attempt to circumvent OPP's payment system to avoid platform fees.
• Interfere with the site's operation or attempt to access accounts or data that aren't yours.

6. Disclaimers

OPP is provided “as is.” We don't guarantee that plant matches, zone data, or inventory shown will be perfectly accurate, or that the service will be uninterrupted or error-free. We are not responsible for the quality, safety, or legality of listings, or for the conduct of buyers or vendors.

7. Limitation of liability

To the fullest extent permitted by law, OPP is not liable for indirect, incidental, or consequential damages arising from your use of the platform, or for disputes between buyers and vendors. Our total liability for any claim is limited to the platform fees we received related to the transaction giving rise to the claim.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms, with notice where practical.

9. Changes to these Terms

We'll update the date at the top of this page when these Terms change, and for material changes we'll make a reasonable effort to notify you before they take effect.
